New Zealand Updates Open Work Visa Employment Rules from April 20

New Zealand will implement revised employment rules for holders of open work visas starting April 20, 2026. The move aims to provide migrants with clearer guidance on allowable work and to strengthen adherence to the country’s labour and business regulations.

Under the new framework, open work visas will be grouped into two categories. The first allows holders to work in any lawful capacity, including employment, self-employment, or business ownership. This applies to post-study workers, partners of residents or students, and other specified visa types.


The second category limits holders to employment under an employer, preventing them from running their own businesses. This affects working holiday makers, asylum seekers, victims of domestic violence, and certain protection visa holders.


Authorities emphasized that all visa holders must follow New Zealand’s employment and business laws. Activities such as hiring others through a personal business, operating commercial sexual services, or investing in linked ventures are strictly prohibited.

Immigration officials stated the changes are designed to reduce confusion for migrants and ensure transparent and fair practices in the workforce, while helping employers understand their obligations.

Open work visas differ from employer-specific visas, which tie migrants to a single employer or role, by offering broader employment flexibility under clearly defined rules.

The new conditions will not affect student visa holders, who remain subject to existing regulations regarding work while studying.

This policy update is part of New Zealand’s ongoing efforts to balance migrant opportunity with regulatory compliance across its labour market.
